I can't get my head around this entire sentence for some reason.
Background: The company is an Austrian construction company. The text is a check-list for the non-lawyers in the company to do a sort of rough analysis of a contract to decide if they should put in a bid or not. Many of the users of this text will be non-native English speakers so while I'm interested in the exact phrase (if there is one) it's more important that it is understood by people with only a basic legal understanding.

There are different types of compensation to which a party under a contract may be entitled. In this sentence they are, according to my understanding of the paragraph asking whether that they have to compensate for ‘the positive interests under the contract’ ( including the profit made by the supplier). This concept is called consequential loss in English law. Therefore the question is ' is compensation payble for consequential loss?
