English term

effectively

English Art/Literary Law: Contract(s)
I am translating into Polish a procedural agreement between a company and a trade union.
I am not really sure what ‘’effectively’’ means in this context – efficiently, in effect, in reality, to all intents and purposes,....?

Any help would be greatly appreciated.

‘’2. Scope

This agreement establishes procedures, rates of pay and conditions of employment for trade union members employed by company X as night operatives at its operation in Dublin.
Company X reserves the right to communicate with its employees whenever it wishes to do so and all employees will be kept informed of
discussions and decisions, which affect them.
Company X recognises the trade union’s right to represent their members *effectively* in all matters covered by this agreement.

3. Interpretation

Company X and the trade union agree that any disagreement which arises
in respect of the interpretation or application of this Agreement or any part of this Agreement which cannot be resolved locally will be referred to the labour
court whose decision on the interpretation of this agreement shall be binding.

4. Recognition
Company X recognises the trade union as having sole negotiating rights on
all matters concerning the categories of employees covered by this Agreement,
who are members of the trade union.’’

in effect

I think effectively is used here in the sense of in effect, i.e. for all practical purposes.

exerting force or influence, with authority

If you go to this page:

http://www.google.de/search?hl=de&q=define: effectively&meta...

and you scroll down the list, I would choose the one that says "exerting force or influence". I think that the company has to recognise that the trade union has authority when it represents its members.

Due diligence in business transactions

In business transactions, the due diligence process varies for different types of companies. The relevant areas of concern may include the financial, legal, labour, tax, IT, environment and market/commercial situation of the company. Other areas include intellectual property, real and personal property, insurance and liability coverage, debt instrument review, employee benefits and labour matters, immigration, and international transactions.

If I was proofreading it, I would suggest it be changed to "due diligence" as it would fit better in with legal text. Effectively could be misconstrued in its definition, in a court of law.
