En esta demanda aparece este término, que no acabo de entender. Este es el contexto:

,caso de no accederse a la resolución contractual solicitada por considerarse que en el supuesto que nos ocupa no se cumplen los requisitos previstos en el Art. 1.124 del Código Civil , se condene a la mercantil demandada al saneamiento por los defectos o gravámenes ocultos de la cosa vendida y por tanto , al amparo de lo dispuesto en el Art. 1.484 en relación con el Art. 1.486 ambos del Código Civil , tenga por desistida a la actora del contrato suscrito en su día con la empresa china XXXXXXX , dado que XXXXXX caso de haber conocido los vicios de la mercancía no la habría adquirido.

Seeking to sever, means to divide a contract and keep or waive some agreements therein, but in this case the plaintiff is given the right of waiving or abandonment from contract

"sever" refers to a contract divided into individual agreements, in this case, contract is totally waived or abandonned by the plaintiff. I think that phrase refers to the plaintiff's waiving or abandonment from contract

agree Richard Boulter : This is the better wording for the context, in spite of Jose's being first with the required terminology. Note: the noun form for 'waive' is smoother using 'waiver' to accompany 'abandonment'. Both are used together in Barrons Law Dictionary for this.

plaintiff seeks to sever...

In this example, "desistir" is refering to what the plaintiff would like to do with the contract. The defendant is accused of being in breach of contract. In terms of contract law, the plaintiff is seeking to sever the contract.

consider the contract cancelled in regards to the plaintiff

"cancelled" seems more appropriate to me in reference to a contract
