Programa de rehabilitación vigilada previa al juicio
Bajo el diversion program, el acusado sirve un periodo de probatoria en lugar de que se dicte sentencia. Si lo cumple satisfactoriamente se aplazan el fallo y la sentencia. Aquí no hay ni "parole" -libertad condicional posterior al encarcelamiento, ni "probation" (probatoria o libertad vigilada en lugar de ser sentenciado a prisión). O sea que el programa de rehabilitación se cumple antes que que el juez dicte la sentencia, por lo que el acusado no sabe cuál será su pena a cumplir si no cumple con los requisitos del programa. No he encontrado nunca una traducción técnica - de pronto porque no existe este tipo de mecanismos en nuestros países... me parece que rehabilitación es lo que mejor describe esta opción, pues es el objetivo del progama.

Pre-Trial Diversion When an individual (adult or juvenile) has been charged with a crime, the State Attorney screens the case to determine eligibility for the Pre-Trial Diversion Program. Eligibility is based on prior criminal history and the severity of the crime. If the individual is found appropriate and accepts the program, the case is abated until further notice from the State Attorney. Upon successful completion of the pretrial term, the case is dropped by the State Attorney's Office.

A recent trend in managing drug possession cases is the use of diversion systems such as the Drug Court System or the Deferred Entry of Judgement. Certain offenders are chosen at the judge's discretion, and after a guilty plea, are allowed to enter rehabilitation programs instead of jail or prison. Drug Courts exist in 45 counties, for a total of 101 in the state. Criteria for admission vary greatly by county.
