A declaration of trust (in writing) is a binding statement by the legal owner of an asset, declaring the underlying beneficial interests of the person or persons for whose benefit he holds the legal title. Joint legal owners of an asset may also declare the trusts on which they hold an asset either for themselves or for others beneficially. This helps to avoid future misunderstandings concerning the obligations of the legal owner and the entitlements of those beneficially interested.
A declaration of trust may simply set out existing beneficial interests or can even be the instrument of transfer so that it affects a gift of part, or the entire asset. Although commonly used for holding land, a declaration may be made over chattels, or for declaring the trusts of benefits of a pension or life policy.

Сопоставляем объёмы и составы прав, полномочий, свобод усмотрения и обязанностей доверительного собственника и доверительного управляющего (а заодно и бенефициарного собственника).
Вывод: подмена понятий в переводе -- введение конечного пользователя в заблуждение.
