Here is the whole text:

"Cuando un producto no conforme ostente el marcado CE, haya sido objeto de un marcado CE indebido o dicho marcado CE no figure debiendo figurar, en contra de lo previsto en este Real Decreto, la Agencia Española de Medicamentos y Productos Sanitarios y las demás autoridades sanitarias competentes adoptarán las medidas apropiadas contra el fabricante, el representante autorizado, el importador o el distribuidor, según corresponda."

Not getting this part straight but this is my try:

"Whenever a non-conforming product bears the CE marking, having been subjected to improper CE marking or the CE marking FAILS TO APPEAR, thereby (resulting) an infringement upon the provisions of this Royal Decree, the Spanish Agency of Medicines and Health Care Products and the other competent health authorities shall take appropriate measures against the manufacturer, the attorney-in-fact, the importer or the distributor, as appropriate.
