: I don't think "sur la base de" works because the concept is not "winning litigation because of/on the basis of" X, but "winning X aspect of litigation." See my answer for details. *ETA: changed to neutral, fair enough Ph_B

(D’après notre expérience il est primordial d’avoir des avocats spécialisés dans l’aviation pour présenter votre cas et s’assurer)...que toutes les propositions reflètent avec précision les probabilités que l’affaire reste aux États-Unis et remporte le dossier en terme de responsabilité.
Il me semble que "risks" a une connotation négative, et si l'enjeu est de gagner une affaire sur le plan juridique, je tenterais le terme "probabilités", pour ne pas mettre "chances", et donc rester neutre...? C'est une suggestion..
J'ai parcouru l'article du site ci-dessous pour essayer de comprendre en quoi consistent des liability cases..

: J'ai du mal avec « remporter un dossier » + en termes de + et je ne pense pas qu'il s'agisse des « possibilités » que l'affaire soit jugée aux É.-U., mais des « risques » (coût) que cela comporterait si c'était le cas.

In the US we talk about "winning on liability" vs. "winning on damages." You have to win on liability in order to win on damages (i.e. you have to show that the defendant is liable/legally responsible for the harm before you can make them pay for the harm). Sometimes cases are even bifurcated into two separate trials: first on liability; then, if you win that, another trial solely on damages.
There's very little discussion about "procès bifurqué" on the French web and I don't even know if that procedure exists there, so I wasn't able to find language that is definitely used in the French-speaking world to express this concept. That's why I didn't choose the "I am sure" confidence level. I'm basically making up an expression to convey a concept that may or may not even exist in French law.
But in the US, even when a case is not bifurcated (and they usually aren't), it is still conceptualized as two separate cases that you need to prove: one on liability and the other on damages. It's two different questions: (1) Was this your fault? (2) How much is it worth and how much of that amount should you have to pay?

You might win at summary judgment (the judge decides) or after a full trial (the jury decides), or in formal arbitration you might win by persuading the arbitrators. But in any case, this can only happen after formal proceedings have begun (court filing or, more rarely, formal arbitration proceedings).

Sur le plan de la responsabilité = dans le domaine, du point de vue de la responsabilité.

Il me semble donc que le défendeur qui serait tenu responsable et devrait par conséquent payer des dommages-intérêts perdrait sur la base de la responsabilité tandis que le demandeur gagnerait sur cette base.

Also, if you're a defendant, you don't want the case to stay in the US and you don't want plaintiffs (claimants) to win on liability.
So there are indeed "possible ifs or buts."
Not that it matters for the translation -- we don't need to know which side this law firm wants to represent in possible future litigation in order to translate this marketing spiel.
In the same way no one is "taking the risk" of winning a litigation (unless it's some really wierd situation).
So if the selling point for these lawyers is "we will make aware the other party of the RISK that the case could stay in US", it means that the other party stands to lose from that eventuality. WHO would rather avoid US courts? I would expect the defendants to be keen on staying away from them.
So if "the other party" are those being sued for compensation, these lawyers MUST be acting for claimants.
Can't see any possible ifs nor buts ...
I lean towards thinking it's addressing potential defendants, though. It's civil defendants who do not want the case to stay in the US and do not want the plaintiff to win on liability.
HOWEVER, it could go either way -- a defendant can "win on liability" too (i.e. win a judgment or verdict stating that the harm was NOT the defendant's fault). It's not clear from the sentence whose "winning" is a risk, so it's not clear which party is addressed. And indeed, it could be either. There aren't many areas of the law where law firms have to choose whether to always represent plaintiffs or always represent defendants; in most areas they could represent either side.
Basics of game theory: if these lawyers where acting for defendants the prospect of the claim for compensation being chucked out of a US court would be an opportunity NOT a risk.
Since it says "risks," I take it that these lawyers would be representing defendants who do not want to stay in the US and do not want the plaintiff to win on liability.

Effectivement, on ne sait pas si l’affaire est « en cours » aux É.-U., mais comme vous supposez qu’elle pourrait y « rester » et comme il peut y avoir « contestation » (cf. note de Marwa à Marie Anne), je me suis permis de supposer qu’elle est au moins ouverte/en instance/pendante (ce qui ne présume pas de son degré d’avancement).
On ne sait rien non plus sur la partie (demandeur ou défendeur?) à laquelle s’adresse « We » ou sur ces « offers » (règlement hors cour? services?). Au plan syntaxique, on peut aussi se demander à quoi renvoie « winning ». Faut-il lire :

Hearing the liability and damages portions of trials separately and sequentially would make most civil trials faster… Furthermore, severing more trials would cause stronger parties to win moreoften…
