In einem "consortium agreement" (was ich vorläufig als ARGE-Vertrag übersetze) geht es um die Definition der "affiliates of a party", also der mit einem Vertragspartner verbundenen Personen. Als solche gelten u.a.
Any legal entity that is under common Control with that Party, or a legal entity qualifying as an Affiliate of a Party under (a) above ***through government***.
Im nächsten Absatz wird der Begriff "Control" definiert und im weiteren Kontext heißt es:
Common Control through government does not, in itself, create Affiliate status and any legal entity under common government Control must be specified in accordance with (b) above in order to qualify as an Affiliate.
Gegenstand des Vertrags ist die Gründung einer ARGE für die Umsetzung eines mit EU-Mitteln geförderten Projekts. Meine Frage ist, ob hier mit "government" eine staatliche Stelle (Regierung, Behörde) gemeint ist oder ob "government" hier allgemein "Leitung, Lenkung" heißen soll.
In "(a) above" und "(b) above" steht nichts Erhellendes.

The U.S. Constitution establishes a government based on "federalism," or the sharing of power between the national, and state (and local) governments. Our power-sharing form of government is the opposite of "centralized" governments, such as those in England and France, under which national government maintains total power.
Hier kommt 2x die Bedeutung "Beherrschung", nicht "Regierung (als Institution) vor, es kommt aber auch die zweitgenannte Bedeutung vor - z.B. 'centralized governments' (dann Plural).

Bei linguee bin ich immer etwas skeptisch, aber man kann es als Materialsammlung nutzen. Da gibt es einige Spuren, wenn man Beherrschungsvertrag eingibt:

Under the definition the “enterprise” includes all related activities performed through “common control” for a common business purpose. The word “control” may be defined as the act of fact of controlling; power or authority to control; directing or restraining domination. “Control” thus includes the power or authority to control. Also: if you google "common control through" in the context of "affiliate", you will get quite a number of hits for " common control through common officers, directors,...", and IMO this is exactly what "government" means, here: a company "governed" by a common board of directors.

Discussion
Ich will jetzt die Nuss knacken - Johanna hat wunderbares Material geliefert, ich denke, in dieser Richtung lagen meine Vermutungen.
Dann sind sie Affiliates.
Letztlich, wenn ich jetzt nicht völlig irre, steht da : Gemeinsame Kontrolle durch eine Regierungsstelle ist aber nicht, für sich,genug für den Status als verbundene Person, außer die Regierungsstelle übt Kontrolle aus durch Mehrheitseignerstatus oder beherrschende Stellung (appointment of directors, etc.)
Was ist aber dann, per se, 'Common Control through government' ?
Vielleicht soll bei einem Finanzinvestor oder bei einem Mischkonzern als Eigner eines 'untergebenen Unternehmens' nicht sofort eine 'affiliate'-Eigenschaft unterstellt werden.
- ownership of more than 50% of the nominal value of the issued share capital of the entity or of more than 50% of the issued share capital entitling the holders to vote for the election of directors or persons performing similar functions, or
- right by any other means to elect or appoint directors of the entity (or persons performing similar functions) who have a majority vote.
... under government (kein bestimmter Artikel, keine Spezifizierung, Kleinschreibung) - spricht m.E.
