Without Prejudice Communications
42. 'Without Prejudice' privilege covers oral and written communications and enables the parties in dispute to communicate more frankly than perhaps they would do in 'open' correspondence. The rule is founded on public policy grounds to encourage parties to settle their differences and to avoid the risk of a damaging admission. This is because a communication made 'Without Prejudice' generally has the effect of taking it out of any future legal proceedings as privileged information. With this is mind, all communications with the contractor during the course of a dispute should always be marked 'Without Prejudice'.
