German term

Sentence

German to English Law/Patents Law (general)
Der Vertreter der Antragstellerin stellt den Scheidungsantrag aus der Antragsschrift vom 25.1.1995 (B1. 13 d.A.).

This sentence seems ackward in English when I translate it. Any suggestions?

Based on the brief dated xxx (...),

petitioner's counsel (or possibly "petitioner's representative") submits herewith a petition for divorce.

That's how I'd phrase it. Maybe one of our "legal eagles" will have a more elegant solution.
However, in at least in US legalese, the Antragsteller/in in a divorce case is a petitioner, not a claimant.

Spouse who starts the divorce = Petitioner or Plaintiff
Document filed = Petition or Complaint
The other spouse = Respondent or Defendant
Document filed (if any) = Response or Answer
Orders for divorce and terms = Judgment or Decree

That reference above should have read
From: Divorce Roadmap (and I KNOW I typed that in...; there must be a gremlin around here somewhere)
I also added that you might want to check out that particular site (i.e. \"divorce roadmap\") as it might be useful.

My version

This is how I would handle it - as a non-legal translator:
The brief containing the motion dated xxx represents the counsel for the claimant's petition for divorce.

Peer comment(s):

disagree Ulrike Lieder (X) : Kim, that got turned around somehow - how can a brief represent the counsel??

I was trying to say the brief represents the counsel's petition, but the wording is poor.
