Lebensversicherung mit eigenem Bennenungs-/Bezugsrecht

Hi again, I do pretty much understand what this means, but what I am not 100% sure is who the "eigenem" refers to.

This is part of a last will.

The context is "Zahlungen aus Verträgen zugunsten Dritter (z.b: Lebensversicherungen mit eigenem Bennennungs- oder Bezugsrecht) stehen unmittelbar dem Bezugsberechtigten zu".

"Eigen" bezieht sich auf den Dritten aus dem Vertrag, d. h. auf den Bezugsberechtigten:
"Der Vertrag zugunsten Dritter gestattet es also die Begründung eines Anspruchs und die Zuwendung eines Anspruchs durch ein einziges Rechtsgeschäft zu realisieren. Demnach verpflichtet sich der Schuldner (Versprechender/Versicherer) im so genannten Deckungsverhältnis gegenüber dem Gläubiger (Versprechensempfänger/Versicherungsnehmer) die vertragliche Leistung im so genannten Leistungsverhältnis an einen Dritten (Begünstigten) zu erbringen. Analog gilt das auch für das eigene Benennungsrecht.

I agree with Allegro. There must be a reson why these personal designation and redemption rights are mentioned. I have to admit that I didn't know that there are life insurance policies that don't allow the policy holder to name the beneficiary. It doesn't seem make sense, unless these policies are for specific purposes, such as covering the costs for the funeral, and other costs associated with the death.

redundant or not.. I would not omit any of this. For one thing the company very probably issues policies without the right to name beneficiaries and/or receive benefits and for another a client is highly likely to accuse the translator of omitting content. This is legal text not a newspaper article.

If you left out the phrase you're asking about and just said "life assurance policies", I think it would make just as much sense. Benennungsrecht is presumably the right to name the beneficiary, which I think goes without saying, and Bezugsrecht is the right to receive benefits, which also seems redundant.
