Honestamente, entiendo que la referida ineficacia presenta serias dudas de derecho por la aplicación combinada de los artículos 27,70.2 and 70.7 del ADPIC y el Convenio de Viena sobre derecho de tratados de 23 de mayo de 1969 y del propio concept de "Rserva", que permiten dudar (no de la eficacia de la patente) de la vigencia de la Reserva en que se fundan para oponer la ineficacia. Esas dudas acerca de la prosperabilidad no pueden favorecer a quien la opone.

As I understand it, "I" believe that the claimed lack of validity (la ineficacia referida) could easily not prosper (these are the dudas acerca de la prosperabilidad). That fact cannot favor the person opposing the suit (the one that would assume that "la ineficacia referida" does not apply).

In my opinion the Spanish text is a poor translation from English. The word should be "prosperidad" not "prosperabilidad"
