'The Beneficiaries' shall mean my **Wife** xxx any issue of mine living at my death or born within 21 years after the death of the survivor of me and my said **husband** and any spouse or dependent of such issue and my grandchildren.

La duda que surge es por qué habla de "mi esposa" y "mi marido" en el mismo párrafo, cuando el testamento lo hace un hombre. ¿Alguien entiende por qué? Gracias.

Is there a chance that this was written by a person for whom English was not his first language? If so, I think what is being said is that possibly he may have children with another spouse later on, if by any chance XXX predeceases him. And, thus, "husband" is being used incorrectly when he should have said "spouse."

Esposa/esposo es la persona con quien se ha contraìdo matrimonio; mujer/marido es la persona con quien se convive maritalmente.

husband not only is a man, it is just the other partner of a matrimony

For me, it means that when the testament was done the two spouses were alive, so, both the wife and the husband can be the beneficiairies
