Les membres pourront exclure de la brevetabilité les inventions dont il est nécessaire d’empêcher l’exploitation commerciale sur leur territoire pour protéger l’ordre public ou la moralité, y compris pour protéger la santé et la vie des personnes et des animaux ou préserver les végétaux, ou pour éviter de graves atteintes à l’environnement, à condition que cette exclusion **ne tienne pas uniquement au fait que l’exploitation** est interdite par leur législation.

...provided that this exclusion [from patentability] is not due/made solely because the use [of the invention(s)] is prohibited according to their legislation.

In other words, members may exclude patentability for the reasons listed, but not solely because the invention itself is illegal (in their jurisdiction)

neutral Alan Muscat : Interesting. Do you think though that it might mean "... provided that such exclusion is inapplicable due to the fact that (financial) exploitation is prohibited/illegal" (for other reasons). I am notsure because I am not that "au fait" in French legalese
