Close questions by selecting the answer deemed most helpful (and awarding it points, unless the question was posed as "not-for-points"). Askers who do not close their questions within an appropriate period of time are not permitted to ask further questions. (Note that when no answer is deemed helpful, it is possible to close a question without selecting a most helpful answer.)

Swiss Federal Council English Art 815 Art. 815 C. Effect / VI. Rank / 3. Vacant ranks

3. Vacant ranks

If a subordinate charge is created and no higher-ranking charge exists, or if the debtor has not yet made use of an existing higher-ranking right to create a charge, or if a precedent claim is worth less than the amount recorded in the land register, in the event of foreclosure, the proceeds are distributed among the actual charge creditors according to their rank and irrespective of vacant ranks. The question is....is "vacant ranks" in general use?
Jack Dunwell (asker) Jun 29, 2017:
"Vacant pledge rankings" I can't find reference to this except Proz and suggested translations

Completely unclear. As far as I can see it was xxxAdrian MM who discovered "Nachrukungsrecht"
Jack Dunwell (asker) Jun 29, 2017:
I should be interested in your explanation of that. It means nothing to me
writeaway Jun 29, 2017:
vacant pledge rankings isn't clear enough for you? what has your own research turned up so far? Sorry you think this is unworthy because it happens to be right (according to Swiss banking reference source). Of course I had to find it via the German term because that's how things often go with Swiss translations
Jack Dunwell (asker) Jun 29, 2017:
English I'm interested in a response in English and a ProZ answer which is understandable !!!

• L’expression « sans profit des cases libres » signifie qu’en cas de radiation de la cédule hypothécaire en 1 er rang, celle-ci n’est pas automatiquement remplacée par le titre hypothécaire qui s’accompagne de cette mention.
