I like "finding", that sounds the most appropriate option given the context.

constat In Bridge I have since found "constat" - for "finding" or "hearing". If after that it is confirmed by the "arrêt" - judgment, verdict (or case) - then finding could be an option? Or it could refer to the initial hearing in the arbitration court.

Not sure about paragraph, but if you look at the text that this refers to for example: Décision 2003-489 DC du 29 décembre 2003 (Rec. p. 487), cons. 21.
It looks like this could just be another term for paragraph.
Could it stand for "Considération"?

neutral Aude Sylvain : je ne sais pas s'il existe une traduction + exacte en anglais, mais je pense effectivement que c'est l'idée. Mot français = "considérant" à mon avis, voir réf.
