German term

entwicklen (here)

German to English Law/Patents Law: Contract(s) Non-Disclosure Agreement
"(d) vom Empfänger nachweislich unabhängig und ohne Rückgriff auf vertrauliche Informationen entwickelt worden sind;"

Another exception in a nondisclosure agreement. The recipient of confidential information that is disclosed won't be liable in certain cirumstances, the above being one. I don't understand what "entwickeln" means in this context, and quite frankly, the entire sentence is a mystery to me. I thought that "vertrauliche Information" was the implied subject of entwickeln, but the use of "ohne Rückgriff auf vertrauliche Informationen" seems to throw that idea out the window.

By way of further help, the above excerpt refers back to this:

"Die in §3 dieser Vereinbarung enthaltenen Verpflichtungen gelten nicht für vertrauliche Informationen, solange und soweit diese, gemäß vom Empfänger zu erbringender Nachweise"

Then you get points a, b, c etc. Combining the above excerpts, one gets:

"Die in §3 dieser Vereinbarung enthaltenen Verpflichtungen gelten nicht für vertrauliche Informationen, solange und soweit diese, gemäß vom Empfänger zu erbringender Nachweise vom Empfänger nachweislich unabhängig und ohne Rückgriff auf vertrauliche Informationen entwickelt worden sind"

Not sure if that's much better, actually, but hopefully this pack of legal mud will be much clearer to someone than it is to me. TIA for your quick help (it's quite urgent).

Oops Should of course be "entwickELN" (here).

developed/accomplished/met

the obligations were met by the Empfaenger independently and without using any confidential information, and the Empf. must provide evidence for that

The sentence is "Verpflichtungen sind vom Empfaenger [unabhaengig und (ohne Rueckgriff auf vertrauliche Informationen)] entwickelt worden".

"auf vertrauliche Informationen rückgreifen" is one element

Hope that makes it a bit clearer, I'm sure you'll find a way to phrase it nicely

Thanks Rowan. I don\'t know why I wrote develop. I think I was trying to turn the sentence around to help you and somehow got stuck with develop and then forgot to delete it when seeking for words that worked for obligations.
I had a deadline myself, so I just gave the answers from the top of my head.
I\'m glad I could help.
Peer comment(s):

agree Derek Gill Franßen : I'd probably say developed using non-confidential sources... :)

agree Sabine Griebler : developed, the context is certainly about products which are developed whithout using any confidential information described in this non-disclosure agreement

4 KudoZ points awarded for this answer. Comment: "Developed doesn't make any sense to me if it's referring to obligations. You don't develop obligations, as far as I know. But met or accomplished might work. Idwerk's answer was interesting, but "obtained" didn't really seem to fit "entwickeln". Anyway, I've gone with "met obligations independently". I hope to goodness it will be OK. Thanks to everyone who contributed."
