Judicial Bankruptcy Enquiry or Judicial Bankruptcy Investigation
A trial is used to determine a specific person or persons’ culpability or guilt followed by some or other punishment or acquittal or absolution in the case of civil proceedings, whereas an enquiry or investigation is usually less formalistic and is undertaken to establish firstly the events leading to the bankruptcy and secondly if it can be attributed to the actions on the part of a person or persons. The evidence acquired during the enquiry can under certain circumstances be used during the trial.
