No, allegro-not a guess, but rather from having worked for several clients over the years on these type of documents, including translating for attorneys,Notary Publics, and Trust boards as you can see from my profile . :-)

Vía procedente: hay poco contexto, es un juicio ordinario, sumario? No es un juicio sino una solicitud?

si hablamos de "proceeding" or "procedure" el verbo sí se utiliza y traducir no es siempre escribir literalmente sino que el texto esté redactado con frases estándares en el idioma destino. Además, hace falta tener todo el contexto para decidir.
