The following portion of a ruling of the Spanish Constitutional Court is cited in a case in Peru involving manipulation of the share price of a stock:

No obstante ello, sí debe exigirse que las infracciones y las sanciones reglamentarias encuentren una subordinación directa en la ley, de forma tal que aquéllas no aparezcan como** “giros en el vacío”**, sino que sean consecuencia, cuando menos, de una determinación legal que otorgue competencia al órgano administrativo sancionador, que establezca el bien protegido del que deriva la infracción reglamentada y que contenga, en general, las sanciones que dicho órgano está facultado a imponer."

My take In the Spanish (Spain) legal system, first you get a Ley, which prohibits stuff on a general basis, and then you get the Reglamento, which provides specific definitions of what is prohibited and sets out the corresponding penalties. It is possible for a Ley to prohibit something, but if there is no Reglamento providing definitions and penalties, it is very difficult for anyone to be found guilty and punished.
Here I think they are talking about the opposite case, i.e. where a Reglamento defines prohibited conduct and sets out penalties, but without being backed by a prohibition in the overarching Ley.
