In dreptul american, garantia reala mobiliara (“security interest”) este definita ca un complex de relatii
in legatura cu un bun mobil, constand din pretentiile asupra acelui bun si in limitarile impuse acestor pretentii,
care iau nastere prin incheierea unui contract. Originea contractuala a garantiei mobiliare o diferentiaza de
drepturile reale de garantie care se dobandesc in temeiul legii, cum sunt privilegiile legale.

Garanţia reală mobiliară

Garanţia reală reglementată de Titlul VI al Legii nr.99/1999 constituie un drept real care are ca finalitate garantarea îndeplinirii oricărei obligaţii.

Garanţia reală acordă creditorului garantat dreptul de a-şi satisface creanţa cu bunul afectat garanţiei înaintea oricărui creditor negarantat şi înaintea altor creditori ale căror garanţii reale sau drepturi asupra bunului afectat garanţiei au un grad de prioritate inferior, potrivit dispoziţiilor legii.
