I am having a tough time trying to discern what this is. It appears in the following sentence:
"A AGU ajuizou a presente Ação Cautelar de Busca e Apreensão com pedido de liminar, requerendo mandado de busca e apreensão de objetos, papeis..."
The way I have it, is: "AGU filed this Preliminary Search and Seizure Injunction, requiring a search warrant for the objects, documents, ..."
However, I cannot help but feel something is missing. Any help?

Yes, I vahuely know what the term is, but I just don's see how it fits in the entire sentence. Meaning, we have the "Ação Cautelar" which in my understanding is a "Preventive Injucntion", and then we have "com pedido de liminar", which I thought a "medida liminar" meant a "preliminary injunction" or justplain "Injunction". So, what would itg be?: "AGU filed this Preventive Search and Seizure Injunction, with a request for preliminary injunction requiring a search warrant for the objects, documents, ..."? |

Are a preliminary injunction and a preliminary order the exact same thing? My problem is that many of these terms have been translated the same way by different people, and I don't know how to reconcile them when more than one appear together in one sentence (refer to the question you removed). In other words, some people translate "medida liminar" as plainly injunction, but at the same time, others translate "Medida cautelar" as injunction too, and the problem is that they both appear in the same sentence as if they were different things. So, I guess I'm trying to figure out if I need to add the word "preliminary" and "preventive" before each iinjunction, and if so, are they different things, because it just seems as if the difference would be quite subtle. |
