After having thoroughly assessed the information submitted by Italy on 12 August 2013, 30 September 2013, 15 October 2013 and 14 February 2014, the Commission concludes that there are still 9 (out of the 14 remaining) installations, still not compliant with the ECJ ECJ (European Court of Justice) ruling and, consequently, with the IPPC Directive.

The Commission services can only ** conclude compliance ** with the ECJ ruling, provided that Italy gives clear and convincing evidence of either having issued or reconsidered and, if necessary, updated the IPPC permits for the remaining plants, or of permanent and effective shut-down of these plants (with due regard to the IPPC Directive requirements concerning the definitive cessation of the activities) or, finally, of the fact that these plants no longer qualify as "existing installations" within the meaning of Art. 2(4) of the IPPC Directive.
