Wichtig ist m.E. vor allem das Wort "übergegangen". Es wird nämlich von einem nicht-streitigen zu einem streitigen (im CH-Deutsch übrigens auch als "strittig" bezeichnet) Verfahren gewechselt.
Mein Übersetzungsvorschlag wäre deshalb vielleicht:
"... change course to a *contentious procedure*
Beispiel aus EUR-Lex:
(s. Link unten Punkt 47: "etwaiges streitiges Verfahren" -> "any contentious procedure"
(kann aus unerfindlichen Gründen den ganzen Satz wegen seiner Länge nicht zitieren).

However, the context here seems to imply that the theoretical approach to the proceedings (sic) is what is meant here. Please see the following link (ok, it EU speak again, but they're in a EU country after all..) for the usage of BOTH TERMS in the same text:
