Decreto di omologazione

Italian to English Law/Patents Law (general) separation and divorce procedures
The context is the final separation of a couple, before divorce but after the prescribed attempt at reconciliation. The decree is issued by the courts, with the consent of the Public Prosecutor (Pubblico Ministero). Is there an English equivalent, or should I just write "Decree of Permanent Separation"?

Decree of validation/approval (of separation agreement)

The Tribunal approves/validates the parties' separation agreement, after checking its adequacy/appropriateness/compliance with the law

EUR-LEX uses "Decree of validation" for "decreto di omologazione" of the "concordato preventivo" here:

http://eur-lex.europa.eu/Notice.do?mode=dbl&lang=en&lng1=en,...

Mutatis mutandis, "decree of validation" can also be a good translation for this other kind of "decreto di omologazione".

In fact, in both cases the Tribunal intervenes after an agreement has been entered into by the parties (the former spouses or the entrepreneur/his creditors, as the case may be), issuing a decree to validate/approve the content of such agreement (essentially) after checking its compliance with the law.

for clarification:

1) the decree we are talking about is issued by the Tribunal well before DIVORCE, and has absolutely nothing to do with recognition of foreign decrees/judgments/etc.

2) this is the Article of the Italian Civil Code (art. 158 c.c.) that regulates the matter in hand:

And this is the Article of the Italian Code of Civil Procedure (art. 711 c.p.c) that regulates the matter:

"La separazione consensuale acquista efficacia con la OMOLOGAZIONE del tribunale, il quale provvede in camera di consiglio su relazione del presidente."

This stage ("separazione consensuale") comes YEARS before a DIVORCE, and has nothing to do with the recognition of foreign judicial decisions.

Recognition of Foreign Divorce

Assuming you need a translation of the title.

Otherwise, I would use just "recognition".

see: http://www.hcch.net/index_en.php?act=conventions.text&cid=80

(Recognition of Divorces and Legal Separations Act 1971)

neutral Sebastiano Massimo Barbagallo : the decree in question comes years before a divorce (we are at the stage of separation, which comes years before a divorce proper), and has nothing to do with the recognition of a foreign judicial decision.
