French term

la partie la plus diligente

French to English Law/Patents
Dans un contrat de mariage optant pour le régime de la participation aux acquêts :l'interdiction est cantonnée dans l'espace d'un commun accord entre les parties, et, à défaut, par experts désignés à l'amiable ou en justice à la requête de la partie la plus diligente.

the first party to take action

the literal translation is absolutely incorrect. That's one of the first things I learned in an F>E legal translation course at NYU. It's really hard to find documentation, but even in Bridge you'll find:

"diligence de la partie - sstem in which the initiative in commencing and pursuing teh proceedings lies with the parties"

agree CMJ_Trans (X) : except that in a marriage there are normally 2 people, so it would probably be "more" and not "most" (unless you are Princess Diana!)

I'm not, thanks, but there's only one Google hit for "more diligent party" and it's from an Italian translation.
agree jeanmarc : I feel more for most, but don't know why! It remembers me of the last words of the French grammarian Vaugelas on his dying bed: Je m'en vais ou je m'en vas; l'un ou l'autre se dit ou se disent"

disagree Jacques Saleh : Totally... the meaning of "diligente" here is not "careful" or "earnest" but "speedier" ie the first person to take action; "diligent party" in English is translated in French as "bon pere de famille" in legal context

That's what it means in legal English, too. Take a look at my references. Do you think they are talking about the best "pere de famille"?

on the other party's application

This is also what it boils down to. I'm unsure earlier application would add anything.
