the literal translation is absolutely incorrect. That's one of the first things I learned in an F>E legal translation course at NYU. It's really hard to find documentation, but even in Bridge you'll find:
"diligence de la partie - sstem in which the initiative in commencing and pursuing teh proceedings lies with the parties"

: Totally... the meaning of "diligente" here is not "careful" or "earnest" but "speedier" ie the first person to take action; "diligent party" in English is translated in French as "bon pere de famille" in legal context
