German term
schutzwürdiges Interesse
German to English
Law/Patents
Law (general)
custody case
I'd appreciate some help from our legal eagles with this sentence. The individual terms and the meaning are clear to me, I just need some assistance with the entire sentence construction, please;)
Background: German parents, not married, one child, originally all 3 residing in Canada.
Mother takes child, moves back to Germany and applies for sole custody at the locally competent German court .
Father meanwhile applies for a temporary order to award sole custody to him (which is granted to him by the Canadian court). Child is ordered to be returned to Canada. Now the German court rejects the mother's request to be awarded sole custody.
Here goes:
Thanks very much!

protectable interest
The translation for schutzwürdige Eigentumsrechte in Schäfer is "protectable types of ownership rights."
A protectable interest in a court decision, which in any case cannot be used as a binding decision in rebuttal to the provisional order by the Canadian court, can therefore not be recognized.

UNITED STATES DISTRICT COURT

The applicants fail to meet the requirements of intervention as of right because their asserted interest in foreclosing the possibility that a Massachusetts school teacher might expose students to a viewpoint that the applicants dislike but that the Defendants have found educationally suitable is not a significantly protectable interest.
Regardless of how this lawsuit is decided, the intervener-applicants have no “significantly protectable interest” in its outcome. Donaldson v. United States, 400 U.S. 517, 531 (1971) (emphasis added).
