I know the concept but I'm not sure about the proper legal translation.

continuing contract

Having the benefit of seeing all the other answers and Thumb's comments, I agree that "executory contract" does not exactly correspond to the asker's term.

I offer "continuing contract" as an equivalent. I think "contract of continuing performance" would also work.

Black's says: "A contract calling for periodic performances." This is exactly what the asker's term means.

On the other hand, I have seen the term "contract for single performance" used to mean "contrato de ejecución única".

As for "contrato de ejecución instantánea", I think "contract for immediate performance" would be most accurate. A distinction could be made between this and the former (de ejecución única), under which the one-time performance may not be immediate (specified for a later date).

in the future.the speaker/writer doesn't wish any aspect of the contract in question to prejudice any possible future ones.

disagree Wm Steinmetz (X) : Renewable has to do with the term only. "Execución sucesiva" means performance is periodic, regardless of whether or not the original term is renewed or extended.

agree Adrian MM. (X) : though this is not a felicitous wording, it is right, as Robert & Wm should see that it contrasts with a contrato de ejecucion INSTANTANEA that has to be performed at the time of contracting i.e. a simple shopping transaction.

En Argentina por lo menos, también se llaman "contratos de tracto sucesivo":

# Contrato de Tracto Sucesivo: es aquel en que el cumplimiento de las prestaciones se realiza en un periodo determinado, y que, por deseo de las partes se puede extender para satisfacer sus necesidades primordiales y éstos términos pueden ser:

* Ejecución continuada: ejecución única pero sin interrupción.
* Ejecución periódica: varias prestaciones que se ejecutan en fechas establecidas.
* Ejecución interminente: se da cuando lo solicita la otra parte.

staggered contract

I don't think either executory = promise to perform the WHOLE contract in the future or Butterworth's contract to be peformed over a given period of time is right: a contrato de ejecucion instantanea looks like the possite, but so does contrato de ejecucion unica which is also over a 'given' period of time.


Example sentence:

... salvo que los correspondientes al periodo real de ejecución produzcan un ... la ejecución sucesiva del contrato y el general para su total realización. ...

In an economy with staggered contracts and real growth in the ... rates of prices and wages, due to staggered contracts and monopolistic ...

disagree Wm Steinmetz (X) : First reference not in English. Second reference not written by native English speaker. "Staggered" refers to wages or prices, not the contract itself. The standard term is "staggered wage contract" or "staggered price contract".
