tutiorism
'tutiorismo difensivo' = 'defensive tutiorism'
It's from the theory of ethics.
See the following text on the 1st referenced page:
The English equivalent can be found on the 2nd page: "And that is indeed how loyal Roman Catholics are and have been expected to approach the teachings of their Church. This, however, does not bear on the moral issue save for those for whom tutiorism counts as the moral option)."
So, 'tutiorism' is a kind of rule to be applied in case a moral dilemma arises. I haven't found 'tutiorismo difensivo' but as far as I understand the quoted Italian text this kind of 'tutiorism' requires either the action that allows to avoid bad consequences, or an action aimed to protect an endangered person. Depends on the context.

rigorous defense
I am in FULL agreement with my colleagues about "tutiorism" and its place in theology. Nevertheless, could it be possible that a lawyer "appropriated" the term to describe the "rigor" with which a patent defense would be pursued? Afer all, it's a matter of "probabilities," isn't it? Just food for thought. Good luck, P. By the way, the New Advent page is an excellent source.

letter of the law approach
An idea ...
I have found no examples of tutiorism used in a legal context.
In R.C. moral theology it is the doctrine that in a case of doubt between right and wrong one should take the safer course, i.e. the one in verbal agreement with the law."
In English law there is a contrast between equity (fairness) and applying the strict letter of the law.

The strict "letter of the law" approach to treaty implementation taken by OSIA teams periodically strained working relations

On the facts of the case, the government's position is stronger than Microsoft's case law,letter-of-the-law approach, said many antitrust experts.
