German term

verrechnet mit dem anteiligen Urlaub

German to English Law/Patents Human Resources employment contract
I'm in trouble whenever I have to deal with "verrechnen" and "anteilig". Math was never my strong point. Does this sound right?

When joining the company during the first six months of the calendar year you will receive the full annual vacation benefits, offset in proportion to vacation due for work performed for previous employers.

less the holiday to which you would have been entitled

'less the holiday to which you would have been entitled (ie had you worked for us) during the period of your employment with your previous employers'

more difficult than it looks, this one. As I read it, the 'anteilger Urlaub' can only refer to the holiday entitlement due from the new employer not the entitlement/holiday taken from the old one. Otherwise, the new employer will be granting additional holiday/clawing back holiday to the extent that the entitlement under the old employer was less/more than under the new one, and why would he do that?

If it simply refers to the entitlement *at the rate granted by the new employer* which would have accrued if the person had been employed from the start of the year, then someone joining on, say, May 1 will be entitled to 20 days. If 'anteiliger Urlaub' refers to the *previous* holiday entitlement or time taken, then an employee joining on May 1 might be entitled (taking it to extremes) to anything from 0-30 days holiday for the first eight months, depending on the previous terms, which doesn't seem to make much sense?

just to be clear, 'the first eight months' means the first eight months of the new employment ie May1 to December 31, not the first eight months of the calendar year
Peer comment(s):

agree TonyTK : Sounds right. Would that mean that someone joining the co. on September 1st who had already taken too weeks (10 days) holiday would be out of paid holiday for the calendar year in question?

yup, that appears to be exactly what it is saying, which seems ridiculous to me and is why I admit I don't understand the 2nd half-year bit (or why the previous entitlement has any relevance at all to the new one, for that matter)

German term (edited): verrechnet mit dem anteiligen Urlaub...

taking proportional account of any holiday entitlement...

taking proportional account of any holiday entitlement earned in previous employments

I think they are unwilling to grant holiday (vacation) entitlement to anyone who may have been unemployed before being hired

(gewährten Urlaub – already taken)

Between Jan and the end of June it is unlikely that much if any holiday entitlement will have been used.

minus/less the number of days due from previous employers

adjusted proportionately

An employee joining the company during the first six months of the calendar year will be eligible for the full annual leave entitlement, adjusted proportionately by the leave entitlement transferred from the previous employment.

For the phrase "leave entitlement transferred", see
