German term

diese zu vollziehen

German to English Law/Patents Law (general) court verdict re infringement

This whole sentence is confounding - wonder if s/thing is missing after 'diese'
from 'bei Meidung . . .' to 'zwei Jahren' is fine, but 'diese zu vollziehen an ihren gesetzlichen Vertretern' is puzzling.

Any help would be great.

Discussion

gangels (X) Jun 14, 2013:
Sebastian Witte Well, anyone with prokura (right to speak and sign for the co.) is an 'officer of the company', so just add officers into the mix (although they probably don't do the direct selling).
Sebastian Witte Jun 14, 2013:
gangels, pls take a look: "Der Vorstand für seine Aktiengesellschaft oder seinen eingetragenen Verein, der Geschäftsführer für seine GmbH oder der Gesellschafter für die offene Handelsgesellschaft sind ebenfalls gesetzliche Vertreter." http://de.wikipedia.org/wiki/Gesetzlicher_Vertreter_(Deutsch...
Kirsten Bodart Jun 14, 2013:
Hm but couldn't 'diese' by in the plural, though. Otherwise, you're Sebastian.
Still, I think a legal representative is only the person(s) who can sign on behalf of the company. Mostly it CEOs or directors or so.
gangels (X) Jun 14, 2013:
Die gesetzlichen Vertreter in this case are probably sales agents/representatives/franchisees/lobbyists or others working on behalf or in cooperation with the company. To wit: however sells the co's stuff is liable to go to prison
Sebastian Witte Jun 14, 2013:
Diese IMO only refers to Ordnungshaft The company pays any fines, not its managing directors or senior executives. Ordnungsgeld and vollziehen don't go together that well, anyway, in German.
Kirsten Bodart Jun 14, 2013:
With Horst all the aforementioned' to be imposed on its legal representatives would be a good idea.
Horst Huber (X) Jun 14, 2013:
"Diese" plainly relates to "Ordnungsgeldes" and the several forms of "Ordnungshaft", which are to be faced by the "gesetzlichen Vertreter".

agree Johanna Timm, PhD : Kinder/Minderjährige werden aber kaum Druckmaterialbehälter anbieten und koennen auch nicht zu Ordnungsstrafen verurteilt werden...:-) "imposed on" seems fine

In der Tat - naechstes Mal bitte den ganzen Abschnitt lesen, Herr Martin :-)
agree philgoddard : It's not guardians, it's legal representatives, but strictly speaking your answer is right.

liable to be imprisoned

with the company's sales representatives/official agents liable to be imprisoned for no more than two years in the event of a repeat violation.

Instead of 'up to', the wording usually is 'for no more than'.

to be imposed upon

The Defendant is ordered in order to avoid an administrative fine of up to € 250.000,00 for each case of infringement, to be established by the Court, or alternatively a prison sentence of up to 6 months, or a prison sentence of up to 6 months, and up to two years in the case of repeat infringement, with the prison sentence to be imposed upon the Defendant’s legal representatives, to cease and desist from the following:

Guardians is wrong, I'm afraid. That's a word for parents etc. in family law. This one means the executive/managing directors, authorized officers holding general power of attorney and so forth, people authorized to represent the company by way of a POA, that is.

Or perhaps "with the latter [or the prison sentence, for clarity] to be served by its legal representatives"
Peer comment(s):

neutral philgoddard : How is this different to Michael's answer? He mistranslated Verteter, but that's not part of the question.

Well, I do think it actually is, I'm afraid. We're translating a standardized key phrase from IP judgments the Asker fails to really understand, with legal representatives being a key term thereunder.
